Kansas City, Kansas -Dow Chemical Co. has asked the court which imposed a $400m fine for its part in a to overturn its verdict on a matter of law or re-try the case.
In a filing on 5 March, Dow wants the court to decide that it was inappropriate to try the case as a class action because of a decision that the US courts made in 2008 about the relevance of class actions.
Dow also says that it should have judgement because the plaintiffs could not prove that the conspiracy actually happened and there was no evidence of overpayments to Dow before 24 November 2000.
A deputy clerk at the Kansas City Robert J. Dole courthouse confirmed to UTI in a telephone conversation on 6 March that the filing had been made. A telephone meeting to update the status of the case is scheduled to be held on 20 March.
