Washington -- Dow Chemical appealed to the Supreme Court for a judicial review of a price-fixing fine and compensation order in a class action suit.
The company applied for the review on 9 March - as utech-polyurethane.com previously reported it would, and associate justice Sonia Sotomayor is presiding.
After the company was fined $1.1bn for its part in a urethane antitrust conspiracy it launched an appeal in the 10th Circuit Appeals Court. The appeal is on the basis that the class action used to bring the case is not valid.
As more information on the bid becomes available, utech-polyurethane.com will publish details of the firm’s appeal.
Already the courts rejected Dow's bid to have the case struck out under the fifth amendment, as previously reported at utech-polyurethane.com.
