Lexington, Kentucky - Foam bedding producer Tempur-Pedic International Inc. indicated that its proposed acquisition of another bedding company, Sealy Corp. is proceeding according to plan.
Tempur said that it has refiled its HSR antitrust notification, which resulted in a new 30-day waiting period under the Act. That new 30-day period will expire 30 Nov 2012 -- unless the Federal Trade Commission issues a second request for additional information and documentation.
The company also noted that this refiling and extension of the waiting period is consistent with its initial expectations for the regulatory process.
In addition, Tempur confirmed that the time period under the agreement with Sealy during which Sealy could terminate the merger agreement to accept a 'superior proposal' has expired.
Tempur-Pedic International Inc. makes mattresses and pillows made from its proprietary Tempur pressure-relieving viscoelastic foam material, and claims to be "the worldwide leader in premium and speciality sleep."
Its products are currently sold in over 80 countries.
